Old iPhone 4s off contract unlocking

A friend has a iPhone 4s that is off contract and which they have upgraded to iPhone 5c ie same phone number. They are willing to give me the 4s that they no longer use. However I am not on MTS and even though the 4s is no longer on MTS nor on contract I understand that MTS requires $50 charge to unlock it. Does the person who had the phone under contract have to request the unlock code? Could they give me the phone and I could go into an MTS centre and get it unlocked myself?

Morning Pcguy! Bryan S here from wireless. Anyone can request an unlock for a device. If the device is in good standing i.e. not stolen past due account. You can either go to a dealer or call in and we can charge the fee via a credit card. Hope this helps!! Have a great day.
